Phoenix Reopening Closed Cases Lawyers

Prescott Reopen Injury Claims Lawyers

Our Flagstaff legal team understands the rules and regulations governing your workers' compensation case. Workers' compensation provides medical benefits, wage replacement and possible permanent disability benefits. We have dedicated our law practice to helping workers pursue appropriate benefits for their work-related injuries and lost wages. We understand that you have the right to reopen a closed case under specific conditions.

At Fendon Law Firm, P.C., our Phoenix attorneys possess more than 40 years of combined experience handling workman's compensation cases. Our founding partner, Don Fendon, is one of Arizona's longest-practicing lawyers and was in the first group of Arizona lawyers to be certified as a specialist in workers' compensation law by the state board of legal specialization.

Reopening Cases

You are entitled to reopen your workers' compensation case during your lifetime under three situations. You must prove that since your case closed you have experienced a condition that falls under one of these categories:

  • New
  • Additional
  • Previously undiscovered

To be successful under workers' compensation benefit guidelines, you MUST have an updated medical record from an Arizona physician. If you have moved out of state and try to reopen an Arizona case, your medical evidence could be excluded. Our Flagstaff attorneys understand the complex process governing the reopening of closed workers' compensation cases. We can help you file a petition with the Industrial Commission of Arizona. Once we file your petition with the commission and the insurance carrier is notified, the carrier has 21 days to respond.
