The Social Security Appeals Process
The first step to start your appeal is to submit what is known as a request for reconsideration. We will fill out the paperwork for you so you do not have to worry about it. In reconsideration, a new case examiner will examine your file and determine if you are eligible for benefits.
If your request is denied or if the new case examiner denies you benefits, we will request a hearing in front of an administrative law judge, then go to the Social Security office to make copies of the agency's file in order to prepare for your hearing.
- At this point, it generally takes 12-16 months from the day you request a hearing to secure a hearing date
- When the hearing takes place, you are proving your case to a judge; there is no defense attorney
