What Happens In An Initial Hearing At The Industrial Commission of Arizona?

When an Arizona injured worker attorney requests a hearing at the Industrial Commission of Arizona, within 2 to 3 months a hearing is usually set. An Administrative Law Judge is assigned to the file and the hearing is scheduled. The first hearing is usually for the testimony of only the injured worker.

Sometimes nonmedical witnesses will appear on behalf of the injured worker or on behalf of the employer in initial hearings. The purpose of the initial hearing is to establish whether or not the injured worker is credible.

The Administrative Law Judge will observe the injured worker during the question and answer sessions called direct examination and cross-examination. If for some reason the injured worker does not come across to the judge as believable, the Arizona injured worker could lose their case right there in the first hearing. That is why it is crucial for the injured worker to be fully prepared for the testimony he or she is going to be giving to the judge.
