Tips to strengthen your workers’ compensation claim

Nobody wants to get injured at work, but due to a myriad of factors (faulty equipment, an unsafe environment, or a poorly trained employee), accidents do happen. This is when workers’ compensation comes into play.

Many companies pay insurance to cover these incidents, but some less reputable companies do not, and will fight the claim.

Even protected workers may have a battle to fight with the insurance companies that pay out these hefty claims. As for-profit companies, this is something they don’t want to do.

No matter the circumstances, you deserve workers’ compensation. You now have medical bills to manage on top of your current budget.

If you hit a snag, are denied, or wish to seek representation from the beginning, an attorney with specialized knowledge of workers’ compensation law will stand by your side to appeal and fight for what you deserve.

Follow the tips below to increase your chances of securing fair workers’ compensation.

Seek medical care as soon as possible

This injury is not an “I twisted my knee playing softball” injury. This injury could severely limit your performance, availability to work, and income. Don’t wait and see. If someone wants to help you, let them.

The injury may not even be that severe, but utilize the protection offered to you and seek compensation for your injury.

Speak with your employer

In many cases, an on-the-job injury occurs without the employer in the vicinity. If they weren’t present, notify them as soon as you can. Your claim loses strength the longer you wait to report your injury.

File your claim quickly

Simply notifying your employer of your injury isn’t enough. You must also file an official claim. Each state has a statute of limitations for filing workers’ comp claims. In Arizona, you have one year from the date of the injury, but as referenced above, the quicker your file, the higher your odds for approval.

Decide on your doctor

Each state has individual rules determining your choice of doctor when related to on-the-job injuries. If you feel like you are being misdiagnosed or poorly treated and want to switch physicians, be sure to alert the workers’ compensation insurance adjuster.

Details are key

No matter who you are speaking to, whether it’s the insurance adjuster, your employer, a medical professional, or your attorney, be specific about the details surrounding your injury. Specifics and consistency are vital when dealing with someone who doesn’t want to pay.

The insurance company is keeping an eye on you

The heftier the claim and desired compensation, the closer the insurance company will monitor you. Sometimes, they’ll even hire a private investigator. Therefore, your message must be detail-oriented and consistent.

Also, unless you want to compromise your position, don’t try to trick the insurance company. Keep yourself off your or anyone else’s social media that would indicate a compromised position, follow all medical instructions to a tee, and be accountable and active at all appointments.

Remember, especially if your injury is severe and requires hefty workers’ compensation, the insurance doesn’t want to pay you. Don’t supply them with information to strengthen their case.
