He is also one of the longest practicing attorneys in Arizona workers' compensation law. Attorney Matt Fendon has worked in the area of Arizona workers' compensation since 2001. In addition, he is a member of the Arizona Association of Lawyers for Injured Workers, the Workers' Injury Law & Advocacy Group and the Arizona Trial Lawyers Association and the Workers' Compensation Section of the state bar.

Understanding Lost Wages

Following a work injury, when your workers' compensation case is accepted and opened, you are entitled to temporary compensation. You are paid based on your average monthly wage at the time of the injury. Under the statute, you receive 66 and two-thirds percent of your average monthly wage. Every year wages are capped, or limited, based on several factors including the cost of living. The insurance carriers frequently set the wages incorrectly.

At Fendon Law Firm, P.C., with offices in Phoenix, Prescott and Flagstaff, our experienced legal team can help ensure you receive proper temporary compensation after a work injury. We are committed to protecting your rights at every stage of your case. We can review your lost wage status to determine if your wages were properly calculated.

Appealing Errors

If we feel an error occurred when calculating your lost wage amount, we can appeal. You have 90 days after your wage notice is issued to appeal the notice of average monthly wage. We can gather and coordinate appropriate financial documentation to help you get the lost wage rate raised to ensure you receive your entitled compensation. We also make sure dependent benefits are paid (if applicable).
