Quitting an Arizona Light Duty Job

Published February 28, 2018 by Matt Fendon Law Group

If you have an open Arizona workers’ compensation case, and you are on a light duty status per your doctor, there is a chance that you have returned to work with the employer you were working for when you were injured.

If your doctor releases you to light duty, the first thing you should do is contact your employer to see if they have a job within your restrictions. If they do have a job within your restrictions, you should promptly accept that position.

As long as the employer is abiding by your doctors’ work restrictions, you should remain in that job. Otherwise, your temporary compensation benefits could be adversely affected.

It is a frequent scenario in Arizona that employers work injured workers outside of their doctors’ work restrictions. If this occurs, the first thing you need to do is contact human resources person and let them know that your supervisors working outside of your restrictions. If that does not rectify, the issue, the second thing you should do is contact the insurance adjuster and let him or her know what is occurring. This is usually another good remedy to fix the problem.

We highly recommend it when you contact the Human Resources person, or your insurance adjuster, that you do it in writing to create a paper trail. Emails are the best way to handle this.

If contacting said people does not fix the problem, you can forfeit your position. However, the insurance adjuster is going to fight you over paying compensation. This is why it’s very very important to contact an experienced workers’ compensation attorney here in Arizona, before you undergo any of these steps.
