How Long Do I Have To File A Workers’ Comp Claim?

Published August 25, 2014 by Matt Fendon Law Group | Firm News

If you have sustained a serious injury or a loved one was killed in a workplace accident, or while performing a work-related task, you may be eligible to file a claim for workers’ compensation benefits. State workers’ compensation laws give individuals one year from the date of the accident, or from the date they become aware that their injury stems from a work-related accident, to file a claim. Failure to file a claim within this time frame will likely result in a denial of benefits.

Any delay in seeking medical attention or informing your employer of your injury could also have a negative impact on the outcome of your claim. You, not your employer or any other party, are responsible for pursuing workers’ compensation benefits if you have a valid claim, and our firm is here to help. For more than 50 years, Fendon Law Firm, P.C. has been providing legal representation to individuals in all types of workers’ compensation cases, and we are more than qualified to assist you as well.

Our founding lawyer is one of the state’s first lawyers to be certified as a specialist in workers’ compensation, and it is this knowledge and expertise which has made it possible for us to recover millions of dollars in settlements and verdicts on behalf of our clients. As soon as you are aware that your injury has been caused as a result of a workplace accident, call our firm to retain legal counsel at once.

We will have a Phoenix workers’ compensation lawyer investigate your accident, advise you of your legal rights and guide you through the claims process. As not all employers or insurance providers are anxious to approve claims and pay workers’ compensation benefits, we will fight to protect your rights so you can seek the compensation you rightfully deserve. We serve clients throughout Phoenix, Flagstaff, Scottsdale, Tucson, and Prescott Valley. Call now!
