I'm attorney Matt Fendon. One of the questions that I get on a regular basis is, can I get Workers' Compensation benefits and Social Security disability benefits at the same time? The answer to that is yes, you can. If you get social security benefits, your worker's comp claim shouldn't be affected at all. In other words, your compensation benefits will not be reduced, your medical benefits will not be affected. On the other hand, if you get on Social Security, and you already have an active worker's comp claim, the amount of money you get on your social security case could be offset by the workers' compensation benefit. The rule of thumb is essentially you can get up to 80% of your average monthly wage between workers' compensation and Social Security disability benefits here in Arizona. So those are important things to know, you can get both benefits, essentially. But there could be an offset for what you're receiving and workers' comp. Again, work comp won't be affected at all, Social Security would be offset potentially by the amount of your workers' comp benefit. It's important to know that if you're on workers' comp, and social security at the same time, let's say your workers' comp benefits stopped, you want to notify Social Security right away because your Social Security benefit could be elevated up essentially. Also, if you settle your workers' comp case full and final, where you walk away from it, and you're on Medicare, or you've applied for social security disability, and it's pending. When we do the settlement we have may have to do something called a Medicare set aside, where you essentially set aside money, the value of the medical to be protected so that we don't ship the cost to Medicare.
