Hi, I'm attorney Matt Fendon. I'm a board certified specialist in workers' compensation law here in Arizona. One of the questions I get asked frequently is what is the workers' comp process? Or how does it work? Well, essentially, if somebody gets injured on the job, whether it's their fault, or their employer's fault, or co-employees fault or someone else's fault, they can file a worker's comp claim fault doesn't come into the equation. It's a no fault system. So generally, what people do if they haven't talked to me first is they file an injury report with their employer, with their doctor, and ultimately, that injury report should get to the Industrial Commission. It doesn't always though. So I tell all my injured workers and potential clients to make sure you file directly with the Industrial Commission, despite what your employer tells you. There's an easy way to do that, you can just do it straight from our website, which is www.FendonLaw.net, and on that page, there's a potential client section. If you click on the potential clients tab, then essentially you can file a worker's report of injury directly with the Industrial Commission. So I recommend that everybody do that when they're hurt on the job because it will speed up the process, once that's filed once the claim is accepted. If you're off work eight days or more on light duty for eight days or more, you're eligible for compensation benefits. If you're not making what you were making at the date of injury, you get 66 2/3 of your average monthly wage, you're also eligible for full medical benefits for that injury, meaning you shouldn't have to pay anything out of pocket. If it's a serious enough injury and you have a permanent disability, then you be may be eligible for additional benefits for that as well. Sometimes the cases settle for lump sums as well, but every case is different. That's the bottom line. No case is the same.
