Hi, I'm attorney Matt Fendon. One of the questions I get asked often is, What should I do if my claim is denied? Well, obviously, if you are injured on the job in Arizona, you have one year to file a workers compensation claim against your employer. To do that, you can go to the Industrial Commission website, and file the workers report of injury directly with the Industrial Commission. Or you can go to our website at www.FendonLaw.net and file it in our potential clients section, which is probably the easiest thing to do. Once you file that what will happen is, the Industrial Commission will notify your employer's insurance, and they will have 21 days to respond, either accepting or denying the claim. If they deny the claim, you will have 90 days to file an appeal against that denial. If you miss the 90 days, there's really nothing you can do. You're kind of out of luck. So it's really crucial that if you do get a denied claim that you do file a request for hearing with the Industrial Commission as soon as possible. You can do that by going to the Industrial Commission website, or again at our website, www.FendonLaw.net in the potential client's section. Once you filed the request for hearing, your case will be set for hearing with an administrative law judge, typically about 90 days down the road in between the date that you file the request and those 90 days there will be the process we call discovery. What discovery essentially is, the defense attorneys, the attorney representing the insurance company, that is the defense attorneys opportunity to send you interrogatory to take your deposition prior to the hearing.
