I'm attorney Matt Fendon. Often one of the questions I get is, if I had a pre-existing condition, can I file a worker's comp claim? If that condition was aggravated? The answer is yes, absolutely. If you had a pre-existing condition that was aggravated by what you were doing on the job, then you can absolutely file a claim for workers compensation benefits. That happens all the time, people have degenerative conditions, and everything is fine. They're not having any symptoms, all of a sudden they have an industrial episode that aggravates that condition. Once that happens, sure enough, they can file a claim. We see it a lot with spinal injuries, people have degeneration in their spine, every day you live on this planet, you degenerate more and more. Essentially, it'll get to a point where you have the straw that broke the camel's back, if you will type injury that will basically set things in motion and create pain and other symptoms from a spinal injury that was once degenerative, meaning once was dormant so this happens all the time. So absolutely if you have a pre-existing condition that you weren't having any problems with, and your work causes that condition to be aggravated.
