I'm board certified in workers' compensation law here in the state of Arizona. One of the frequently asked questions that I receive in my practice are whether someone's workers' comp benefits are taxable. The short answer to that is no generally not. And just so you're wondering, there's usually two types of monetary benefits people receive if they've got an open workers' compensation claim, temporary benefits and permanent disability benefits. Those forms of benefits are generally non taxable income. Where we run into problems is in settlement agreements.
Oftentimes, the insurance carriers will slip confidentiality clauses, as well as severance agreements into the settlement agreements which could potentially make the entire amount of the settlement taxable. It's important that you have someone like me involved in the assistance of your case to make sure that those things are protected against and so your whole settlement doesn't become taxable income.
