Hi, I'm attorney Matt Fendon. One of the questions I get often is, what are death benefits in Arizona workers' comp? Well, if a spouse or a significant other pass, and it's caused by the work that they're doing, they may be entitled to death benefits through a worker's compensation insurance carrier. So, everybody that works at least part-time for any employer in Arizona, that particular employer has to have workers' compensation insurance. So if somebody is killed, while in the course and scope of their employment, the spouse, the children, in even in some scenarios, parents, and siblings can obtain potentially a lifetime benefit from that workers' compensation insurance carrier. So if, for example, a wife is killed on the job, the husband could receive 66, and 2/3 of the wife's average monthly wage for the rest of his life. Now, if he does remarry, he loses the benefit, but he gets a two-year lump sum. So if there are children involved and a spouse, then the spouse and the children share that 66 and 2/3. Like I mentioned before, in some cases, if there's no spouse, if there are no children, the parents can get benefits, if they're wholly or partially dependent. Siblings as well can get benefits if there are no parents and they're dependent, and they're underage. So these are all important things to think about if God forbid, a loved one dies on the job. Also, the insurance company's got to pay up to $5,000 in burial expenses.
